Representative Proceedings (Class Actions)
Representative proceedings commenced under the Civil Procedure (Representative Proceedings) Act 2022, are proceedings brought by seven or more persons, against the same person, where the claims arise out of the same, similar or related circumstances and give rise to a substantial common question of law or fact. Representative proceedings are commonly described as class actions.
Below, under 'Current Class Actions' are links to some court documents filed in cases where a class action has been commenced in this Court.
Management of cases
Representative proceedings are managed by way of judicial case management on a Representative Proceedings List.
Order 18A of the Rules of the Supreme Court 1971 deals with representative proceedings and Consolidated Practice Direction 9.19 provides guidance on how representative proceedings are managed.
Practice Direction 9.19 is designed to facilitate the management of representative proceedings and, in particular, to assist in their prompt and efficient resolution.
Opt-out notices
A group member may opt out of a representative proceeding by completing a Notice for opting out (Form 10B) and emailing it to central.office@justice.wa.gov.au.
