Filing your application with the Court
Presenting documents for filing
You are able to file your application either in person at the Registry or by post.
Please note that if you have COVID-19 symptoms or have had contact with a confirmed case of COVID-19, you MUST NOT present to the Registry.
If you are posting original documents we strongly recommend that you use registered post and take a photocopy of all documents before you send them.

The Court will not return the original will. Instead the Court will attach a photocopy of the will to the Grant of Probate or Letters of Administration with the Will Annexed. The Court retains the original will as a public document in safe custody.
As of 15 April 2024, Australia Post will deliver regular letters every second business day (rather than every business day). To ensure prompt determination of your application, when filing, please provide the court with a suitable email address on which you can be contacted should a requisition be issued.
If a Grant of Probate is made, it will be sent by regular post or you may elect to collect the Probate from the Supreme Court Registry.

Fees payable
You will need to pay a filing fee for the application. The fee is available on the Probate fees page.
Payment may be made by cash, bank cheque, Money Order, Visa, Mastercard or eftpos. Cheques and Money Orders should be made payable to Supreme Court of Western Australia.
*Please note that personal cheques will not be accepted.
Processing your application
Your application will be considered by a Registrar of the Court. The Court aims to process applications within four weeks of receiving applications although complex applications may take longer and the process may be delayed from time-to-time.
